Acceptance of these terms

By accessing probablyfundings.com or submitting a request, you agree to these terms of use and to our privacy policy; if you do not agree, do not use the site.

These terms form a binding agreement between you and Probably Funding ("we," "us" or "our"). Our privacy policy and advertiser disclosure are part of these terms by reference. Specific offers you receive from lenders are governed by those lenders' own terms, not by this document.

Description of the service

Probably Funding provides a free online service that collects information you submit and passes it to participating lenders and lending partners who may offer you a loan.

We are not a lender, loan broker or agent of any lender, and we do not make credit decisions, offer loans, or arrange loan terms. We do not endorse any lender or product. Participating lenders decide independently whether to present an offer, and they set all rates, fees and terms. We may be compensated by lenders and partners as described in our advertiser disclosure. The service, network of lenders, and available loan amounts may change at any time without notice, and the service is not available in all states.

Eligibility to use the service

To submit a request you must be at least 18 years old (or the age of majority in your state), a U.S. resident, and legally able to enter into a binding contract.

You must provide information about yourself only, not about another person, unless you are legally authorized to act on their behalf. Lenders set their own additional requirements, which may include minimum income, an active checking account, a valid email and phone number, and residence in a state where they are licensed. Meeting our eligibility requirements does not mean any lender will make you an offer.

No lender relationship with Probably Funding

Any loan you obtain is solely between you and the lender; Probably Funding is not a party to that agreement and has no responsibility for the lender's actions.

Submitting a request is not an application for credit with us. An offer is likely for many users, but approval is never promised, and a prequalified offer may change after the lender reviews your information. Lenders review credit and may obtain consumer reports from Equifax, Experian, TransUnion or other agencies. Questions about loan terms, payments, collections or credit reporting must be directed to the lender. You are never required to accept any offer.

Accuracy of your information and consent to contact

You agree that everything you submit is true, accurate and complete, and you consent to being contacted about your request by us and by lenders and partners who receive it.

Providing false or misleading information may be unlawful and may result in denial of credit or termination of your access. By submitting a request, you authorize us to share your information with lenders and partners, and you authorize those lenders to verify your information and obtain your credit report. You agree that we, lenders and partners may contact you by email, phone and text at the numbers and addresses you provide, including through automated means, for purposes related to your request. Consent to marketing calls or texts is not a condition of using the service, and you may opt out at any time as described in our privacy policy. Message and data rates may apply.

Prohibited uses

You may use the site only for lawful personal purposes and may not misuse it, interfere with it, or submit requests for anyone but yourself.

You agree not to:

• Submit information about another person without authorization, or impersonate anyone.
• Use the site for any fraudulent, unlawful or unauthorized purpose.
• Use bots, scrapers or other automated tools to access, copy or submit data to the site.
• Attempt to gain unauthorized access to our systems, probe for vulnerabilities, or interfere with the site's operation.
• Upload viruses, malicious code or any content that is harmful or offensive.
• Resell, sublicense or commercially exploit the site or its content without our written permission.

We may suspend or terminate access for anyone who violates these terms.

Intellectual property

The site's content, design, text, graphics and logos belong to Probably Funding or its licensors and are protected by law.

We grant you a limited, revocable, non-exclusive license to view and use the site for personal, non-commercial purposes. You may not copy, modify, distribute or create derivative works from site content without our written consent.

Educational content

Articles, calculators, examples and glossary entries on the site are provided for general information and are not financial, legal or tax advice.

Calculator results and representative examples are estimates and may not reflect the terms a lender offers you. Consider speaking with a qualified professional about your individual situation.

Disclaimers

The site and service are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that you will be matched with a lender, that any lender will make you an offer, or that any offer will have particular terms. We are not responsible for the content, policies, offers or conduct of lenders, partners or other third parties.

Limitation of liability

To the maximum extent permitted by law, Probably Funding is not liable for indirect or consequential losses, and our total liability to you is limited to $100.

In no event will Probably Funding, its officers, employees, agents or partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or credit-related harm, arising out of or related to your use of the site, the service, or any loan or offer, even if advised of the possibility of such damages. Some states do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to defend and hold Probably Funding harmless from claims arising from your misuse of the site or violation of these terms.

This includes reasonable attorneys' fees and costs arising from information you submit, your breach of these terms, or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, and any dispute will be heard in the state or federal courts located in Franklin County, Ohio.

You and we consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.

Changes to these terms

We may update these terms at any time by posting a revised version on this page, and the posted version applies from the moment it appears.

Continued use of the site after changes are posted means you accept the revised terms. If you do not agree, stop using the site.
